Sen. Claire McCaskill will oppose the nomination of Neil Gorsuch to the Supreme Court and vote to support a Democratic filibuster of President Donald Trump's nominee to the Supreme Court.
The Senator called it a "really hard decision" and plans on voting no on both the procedural vote and his confirmation.
In the recording obtained by the paper, McCaskill says she's comfortable voting against Gorsuch, "but I'm very uncomfortable being part of a strategy that's going to open up the Supreme Court to a complete change". And she cited his support for the Supreme Court's Citizens United decision, which allows corporations and unions to contribute unlimited amounts of money to political parties and candidates.
"The President who promised working people he would lift them up has nominated a judge who can't even see them", she wrote. McCaskill's strongest opposition came based on the Endrew F. v. Douglas County School District case, in which Gorsuch sided with a Colorado school district and said it did not violate the Individuals with Disabilities Education Act because the student was making some progress.
McCaskill is running for re-election in 2018 in a state Trump won by 19 percentage points.

In the last 24 hours three other key red-state Democrats made public their position on President Trumps nominee to the high court.
That was a reference to Republican threats to respond to a Democratic filibuster by changing Senate rules and extending the so-called "nuclear option" to Supreme Court nominees, which would essentially allow the Senate to approve a nominee with 51 votes.
Hawley, who worked as a clerk on the 10th Circuit during Gorsuch's first year on the bench, called the judge a "consummate professional" and "incredibly fair and independent-minded judge".
Manchin said he also has the Senate's rules to worry about.
So far only two Democrats - Sens.

Senate Democrats plan to employ the filibuster tactic to block the vote, which would require 60 votes to break.
Absent a thunderbolt from the blue, the Senate Judiciary Committee on Monday will likely vote 11-9 along party lines to approve Judge Neil Gorsuch for a Supreme Court seat kept open past year by Republican hardball.
Sen. Orrin Hatch, R-Utah, the senior member and former chairman of the Senate Judiciary Committee, spoke on the Senate floor Wednesday in response to Senate Democrats' threat to filibuster Gorsuch's nomination.
Missouri's Republican Party fired back, stating McCaskill was initially expected to support Gorsuch, but only because she feared his replacement would be someone more conservative than him. Joe Manchin of West Virginia and Sen.
"I hold no illusions that I will agree with every decision Judge Gorsuch may issue in the future, but I have not found any reasons why this jurist should not be a Supreme Court Justice", a statement from Manchin read, according to Time.
