DOJ: Philly's sanctuary city policies violate federal law

A letter from the Justice Department released Thursday said officials believe NY is violating a law requiring cooperation on immigration enforcement - one of four cities put on notice they were out of compliance.

The decision follows an April notification to New York City and eight other local governments asking them to prove they aren't giving official sanctuary to illegal immigrants. As much as I would be tempted to allow sanctuary cities to secede from the nation, it's probably better to keep the country together, as Abraham Lincoln once said.

The Trump administration has said enforcing immigration law is vital to national security and crime reduction.

Acting Assistant Attorney General Alan Hanson notified Mayor Jim Kenney that Philly stands in violation.

Attorney General Jeff Sessions said in a written statement that sanctuary cities "adopt the view that the protection of criminal aliens is more important than the protection of law-abiding citizens and of the rule of law".

"This is about making every member of this community feel safe because they have access to police, police services and they are willing and able to report crimes when they are either victims or witnesses to those crimes", Harrison said.

U.S. Attorney General Jeff Sessions issued the warning to officials in Cook County, Chicago and three other major cities this week, saying sanctuary laws in place within their jurisdictions may violate federal law and "undermine the safety of their residents".

A law enforcement grant received by the city requires compliance with the law, the letter states.

Wednesday's letter demanded that the city certify that police officers aren't prohibited from contacting federal immigration authorities to ask about an individual's immigration status.

In addition, Philadelphia is suing over other new requirements for policing grants that Sessions imposed on cities in July, aimed at punishing sanctuary cities.

The Justice Department made the assertion in letters to Chicago police Superintendent Eddie Johnson and Cook County Board President Toni Preckwinkle. Landrieu added that the letter failed to note that the NOPD policy "does "not prohibit, or in any way restrict, any government entity or official from sending to, or receiving from, [ICE] information regarding the citizenship or immigration status, lawful or unlawful, of any individual.'" "As such, we continue to state unambiguously that [NOPD policy] does not restrict officers and employees from requesting information regarding immigration status from federal immigration officers", Landrieu said". The pair have threatened to cut off federal funding to the cities - which include Hartford and New Haven - but so far that hasn't happened.
