Specter of Menendez retrial could haunt US Senate Democrats in 2018

The presiding judge declared the mistrial Thursday after interviewing all 12 jurors involved in the case.

Jurors were unable to reach a unanimous verdict - the second time in four days - even though they reviewed evidence slowly and thoroughly, defense attorney Abbe Lowell told U.S. District Judge William Walls.

Outside the courthouse late Wednesday, Menendez had thanked those jurors he said were "asserting my innocence" in the jury room.

"It's not that they're just saying they can not reach a unanimous decision, they're going beyond that and saying they've reviewed all the evidence slowly and thoroughly in great detail...nor are we willing to move away from our strong convictions", Menendez's lawyer Abbe Lowell said.

Menendez, 63, is charged in an 18-count indictment with accepting gifts from close friend and co-defendant Salomon Melgen in return for exerting his political influence.

Prosecutors could refile charges against Menendez, but it is unclear if they will choose to do so. Defense attorneys sought to show jurors that the two men are longtime friends who exchanged gifts out of friendship.

If federal prosecutors choose to try the 11-year incumbent again, it could pose a major headache for Senate Democrats, who already face a daunting electoral map in 2018 in their long-shot quest to take back the chamber. Because the jury failed to reach a verdict, a mistrial would was granted, at which point the government will either pursue a conviction in a new trial or decide not to pursue the case any further.
